The agreement is signed. Now it has to work.
Settlements, consent decrees and regulatory agreements set the standard for effective communication. What they rarely address is the operational layer beneath them — the capacity, documentation and reporting that determine whether the standard is met at the point of need, including after hours and during the unplanned interaction.
bitsign is designed to sit beneath the vendor structure, alongside qualified interpreters and individualized assessment — not as a blanket substitute. Qualified human interpreters remain essential, particularly for complex, sensitive or legally significant interactions. The appropriate aid depends on the interaction.
This briefing outlines where bitsign fits within an existing communication and accommodation structure.
What agreements typically require
Capacity
Qualified services available at the point of need — not only during business hours.
Process
Trained personnel, documented requests, and defined escalation procedures.
Proof
A contemporaneous record of what was requested, provided, and when.
Reporting
Recurring compliance reports under continuing government oversight.
The operational layer
The layer that sits between an obligation and its proof
Most communication programs are strong on intent and thin on operation. bitsign is designed to add four capabilities where that gap tends to open.
- Immediate technical capacity — before a human interpreter connects, when none is available, and during the unplanned admission or overnight shift.
- Contemporaneous access records — time, duration, availability, and usage documented as events happen, rather than reconstructed after a complaint.
- Structured, exportable access data built to support the recurring reports agreements require.
- Encrypted handling and defined data controls, developed to operate under a BAA within existing compliance structures.
How it deploys
- No new hardware — runs on facility-controlled tablets and devices.
- No staff training required to operate.
- Available on demand, with no scheduling.
- Works locally or remotely, on facility networks or secured cellular and Wi-Fi.
A worked example — the access record
A Deaf patient arrives at the ED with chest pain. Staff open bitsign on a facility tablet and select ASL. The patient signs their symptoms; bitsign renders them as speech, and spoken replies return as captions and signing — bidirectional, in real time. The interaction is captured as an access record created in the moment: facility and unit, date and time, request type, session duration, human-interpreter status, any escalation to a video remote interpreter queued in parallel, and the device used. A record created as the event happens, not reconstructed after a complaint.
In practice
Where this fits in a matter
Under an active agreement
Add operational capacity and contemporaneous documentation beneath an existing settlement or consent decree — closing the gap between what the agreement promises and what happens at 2 a.m.
Negotiating a new agreement
Shape realistic, operable terms. Define obligations you can demonstrate compliance with, backed by infrastructure rather than best efforts.
Preventive counsel
Establish readiness before a complaint — immediate capacity and access records that make effective communication demonstrable, not aspirational.
Scope and limits
bitsign is designed to strengthen effective-communication workflows and does not by itself satisfy every ADA, Section 504 or Section 1557 obligation. It operates alongside qualified interpreters and individualized assessment, with escalation to a qualified interpreter wherever the interaction requires it. Any deployment undergoes appropriate security, privacy and accessibility review, and, where applicable, HIPAA / business-associate analysis. This briefing is informational and is not legal advice.
